A

MUST be authorised by SRA if they provide reserved legal activities (irrespective of whether pro-bono)

If not authorised solicitors must still compy with CCS and have indemnity insurance

Common Interest Exception

A

You cannot act if there is a conflict or sig risk of conflict (e.g. interests of clients conflict) UNLESS

  1. Substantially common interest (clear common purpose + strong consensus on how it should be achieved)
  2. Informed consent** in writing **
  3. Effective safeguards to protect confidential information (different fee earner)
  4. Reasonable to act (unreasonable if one client is more vulnerable, negotiation… reasonable if limited no of sols who could advise / lower cost)
