Requirement 1 of procuring
A
- Procuring requires a causal link between the behaviour and the ultimate commission of the offence. The reason the offence was committed needs to be because the procuring took place.

A
- If the person who was procured to commit the offence lacks mens rea, the person who committed the actus reus is an “innocent agent” and in NZ the person who did the procuring is deemed to be the 1o party for constructively committing the actus reus.
