A

The employer will appoint a contractor via the construction contract and separately appoint a team of professional consultants.

The employer bears the responsibility and risk for the design and performance of the team of professional consultants.

A

To allocate the risk to the contract/ have a single point of responsibility for the the designs and production/construction of a project. However, the true single point of responsibility will depend of the terms and conditions of the construction contract with the contractor.

What different ways can a design and build contract be carried out?

  • contractor is left to appoint the employer’s requirements and provide the works as a complete package.
    -Employer can initially appoint a design team to work up the initial design and develop their requirements before the design team is transferred to the contractor.

What is construction management procurement?

A

The employer does not allocate the risk and responsibility to a single main contractor. Instead a construction manager is engaged as a fee- earning profession to manage, programme and co-ordinate the design and construction activities and facilitate collaboration.

The employer will enter into trade contracts with the trade contractors whilst the construction manager will administer the contracts but not enter directly into them. The construction manager is liable to the employer for the proper performance of its construction management services but not for the design or construction of the project by the professional consultants and trade contractors.

A

If they have little experience in construction matters they should reconsider as they will generally be closely involved in each stage of design and construction.

What is management contracting?

A

The employer engages a management contractor to participate in the project as an early stage, contribute expertise to the design, manage the construction of the project. The management contractor does not carry out any of the construction work but manages for the fee which is paid on top of the construction costs incurred. It is essentially 100% subcontracting.

The employer usually also enters into a separate direct agreement with each works contractor.
