When does a decision of a lower court’s evidentiary ruling warrant reversal/remand?
A
When the evidence is improperly admitted/excluded and affects the substantial right of one of the parties, i.e. not harmless error. Abuse of discretion standard applies at motion-in-liming stage (not sure what the standard is for rulings at trial, might be the same).
