Explain pro-government claims under the Federal Claims Collection Act.
Recover money from responsible persons who damage or destroy government property through negligent and/or wrongful acts or omissions

Damage or loss caused by neglience and the claim is for $100 or more; or, if the claim is less than $100, but can be collected easily. Based upon product liability, only with approval form JACC; Based upon a contract and the contracting officer does not intend to assert a claim under the contract; or if an accident or incident involves both a G-claim and a medical Cost reimbursement program claim, investigate the two claims together, but process them separately.
Explain the purpose and content of a demand letter for pro-government claims.
The US uses their right to recover the amount demanded. Use a memorandum with the subject line “Notice of Claim”
Prepare an original addressed to the tortfeaser, Send original via certified mail, return receipt requested.
Possible payment options:
Pay in full, Pay in part (right settlement authority approval), Repair in kind, Installment payments.
Statute of limitations:
Suit must be filed in US District Court within three years after the cause of action accrued in order to toll (stop) statute of limitations.
When should claim be forwarded?
Within three duty days of when the 60 day due process letter is sent.
When will due process letter be sent?
after 30 days
