This chapter governs the definitions regarding privileges unless another provision or context requires otherwise.

§ 901 - “Proceeding”
A
“Proceeding” means any action, hearing, investigation, inquest, or inquiry conducted under the law where a person is legally compelled to provide testimony.

A
Any non-criminal proceeding.

§ 903 - “Criminal Proceeding”
A
Any: 1) criminal action, and 2) actions under the Government Code to remove an elected official from office due to wilful misconduct.

A
“Presiding officer” means the person authorized to rule on a claim of privilege in the proceeding.
