All people can participate in the justice system.
Processes should be impartial and open.
[F] Impartial Processes-
Our courts, judges, magistrates and jury members are impartial
[F] Open Processes-
Having open process helps ensure that people and institutions who administer justice can be scrutinized by the public and held accountable
Participation[F]
Having opportunity to know case against them and prepare a detence and make submission
Equality Defintion
That all people engaging in with the justice system should be treated the same way ensuring that there isn’t any disadvantages or disparity created. Measures should be implemented to allow everyone to engage in with the justice system
[E] Same treatment [Formal Equality]
People must be treated the same way no matter their race, age or gender
[E] Different treatment[Substantive Equality]-
If treating people same way could still cause disadvantages, measures can be put in place to allow people to participate in justice system fairly
Acess Defintion
That all people should be able to engage with the justice system and its processes on informed basis
[A] Engagement
people to have the means and ability to use and participate in the justice system. Access through physical, tech and financial access
[A] Informed Basis-
understand their legal rights and the processes involved in their case
