Pardon Power
President has the power to grant reprieves and pardons for offenses against the US, except in cases of impeachment. (only federal cases.)
Veto Power
President has the power to veto any bill presented to him by congress.
Upon presentment, has 10 days to act not eh proposed legislation
Does nothing at all after 10 days, the bill becomes law without the President’s signature
If congress adjourns before 10 day period is up, the bill doesn’t become law because president didn’t get the full 10 days to respond.
Appointment of Officials
Can appoint all officers of the US with the ADVICE AND CONSENT OF THE SENATE
(including ambassadors and Justices of the Supreme Court)
Congress can delegate the appointment of “inferior officials” to the president without Senate approval.
Removal of Officials
Generally accepted that the President may remove executive appointee without cause (and without senate approval)
FEDERAL JUDGES ARE CANNOT BE REMOVED so long as they have “good behavior”. Must be impeached.
Commander in Chief
President is commander in chief of military, but only congress can declare war. President can take military action without declaring war.
Treaties
President has the exclusive power to negotiate treaties, but a treaty may only be ratified for a 2/3 vote from the senate.
If the treaty is not self-executing, it is not treated as federal law and doesn’t preempt state law.
Executive Agreements
President has the power to enter into executive agreements with foreign nations that do not require the approval of 2/3 of senate and without congressional authorization
International Affairs
In addition to appointing and receiving ambassadors, President has the exclusive power to recognize a foreign gov. President represents and acts for the US in day to day international affairs.
