What are the judges and juror role?
Judge decide question of law
Jurors decide question of fact
What must occur to challenge and evidence ruling?
must affect a substantial right of a party AND
must notify the judge of error for an opportunity to correct
How to notify a judge of error?
Objection if evidence is admitted
Offer of Proof if evidence is excluded
do not need to renew challenge once definitive ruling is made
What is the plain error rule and what is is applicability?
exception that applies if you don’t give the court notice of mistake through objection or offer of proof
error that was obvious on its face appellate court can reverse
What is completeness rule?
for partial introduction of evidence, an adverse party may compel introduction of omitted portion to help explain evidenced

What is judical notice?
courts acceptance of the facts as true
adjudicative facts (facts not heard by jury) subject to judicial notice if fact i not subject of reasonable dispute
How does judicial notice affect jury in criminal and civil cases?
civil: must be instructed to accept notice as conclusive
criminal: instructed that it may or may not accept
What is the scope of direct examination?
cant ask leading questions unless
setting up preliminary/background information
witness has trouble communicating (child, elderly, anxious)
hostile witness
What is the scope of cross examination?
leading questions permitted
only discuss what occurred on direct
What are improper questions to ask?

conclusive cant be challenged by contrary evidence
When does FRE not apply?
