MR 39
Conditions under which authorised prescribers and vets may prescribed prescription medicines
1-a if under their care and within their scope of practice
1b- not prohibited by a notice under seection 48(1)
2-designated prescribers may only prescribe if
a- class or description authorised by regulators
b- requirement specified under those regulations are satisfied
c-vet for treatment of animal under their care
MR 39A
Limit on period of supply of prescription meds
1- Not exeed
a-6months supplly in case of OC
b-3months supply in any other
2 DG may authorise a- authorised prescriber to prescribe for any patient, any class or classes of patients a quantity of prescription medicine exceeding 1a or 1b
MR 40
Prescriptions to comply with regulations
1-except 40A, every authorised prescriber or vet who issues prescription must comply with MR 41
2-applies to prescription for any medicine (whether prescription medicine or not)
3- (2) does not prevent sale by retail or dispensing med (other than prescription medicine) without prescription
MR 40A
Urgently required prescription medicines may be orally communicated
1- authorised prescriber or vet surgeon may communicate orally to a pharmacist whom is known personally (phone or in person) if urgently required
2- Within 7 days after communication, prescription must be forwarded to pharmacist to confirm oral communication
MR 41
Form of prescription
a- legibly printed
b-signed personally with usual signature and dated
c-prescriber info; full name, address of work or postal and telephone number
d- full name and address or patient and if under 13 years need date of birth
e- name and strength of medication
f- total amount sold or dispensed
g- if injection or insert into any cavity or swallowing - dose and frequency
h- external use: method and frequency
i- if for an animal - full name and addrrress or owner and “NOT FOR HUMAN USE”
MR42
Dispensing prescription medicines
1 except in subclause 2 no other person other than authorised prescriber, vet, pharmacist, pharmacy graduates, pharmacy technician, or dispensary technician may dispense prescription medicine
1A - may dispense under direct supervision of pharmacist dispensary tech, pharmacy graduate pharmacy technician pharmacy student
2- employee or agent of a vet can dispense prescription medicine at direction of vet for use in treating animal under care of vet
3- Every person dispensing prescription medicine must
a- communicated orally under 40A must not be dispensed more than once before pharmacist receives written prescription
b- information required: name and address of dispensary date of dispensing quantity, unique ID number or code
c- must not be dispensed 6 months after it was printed (other than OC
d- OC must not be dispensed after 9 months from which it was printed
e- retain presccription for 3 years on premises
4- if referred by its brand name or manufacturer a pharmacist may supply an alternative brand provided that
a- has not marked “no brand substitution permitted” or similar meaning
b-substitute contains same active ingredient and no other
c- same dose form and strength
d- no clinical reason why it should not be supplied
e- records brand substitution
f- signs and dates prescription
g- informs patient of brand substitution
MR 43
DG may waive certain requirements
1 a and b - despite 41 and 42 DG may authorise a prescription that dose not comply with 41 and 42 but subject to other requirements that he or she thinks is fit
2 not limited to an electronic form prescription
MR 44
Prescription medicines may not be require prescription in certain canses
Prescription med may be sold or dispensed other than by prescription for
a- licensed to sell by wholesale
b-person obtaining for manufacture or trade not involving resale
c- analyst approve by DG for research purpose
d-hospital care operator
e- pharmacist in control of pharmacy
f- authroised prescriber or vet
g- patient under care by an authorised prescriber
i- Mater of NZ ship
j-emergency medical kit for any vessel
k-aircraft
n- vet
o- authorised distributer or administrator
MR 44A
Administration of vaccines in approved immunisation programme
1- medical practitioner or other person authorised by DG to administer for approved programme
2-authorised person must have documentation of
a- basic emergency techniques including resuscitation and treatment of anaphylaxis
b- safe and effective handling of products and equipment
c-clinical interpersonal skills
d-knowledge of relevant disease to explain vaccination to patient or caregiver
3-authoriseation valid for 2 years
4- authorisation may be withdrawn at any time
MR 44B
Duty to supply information
1- Medical officer of Health may require any authorized prescriber to supply information relating to presccribing or administer or supplying prescription medicine if suspected improper procedures
2- requirement to supply info must be in writing stating medical officer of health suspicion
3 infomation required: a- age of patient b-diagnosis of condition c-prognosis of condition d-specialist referal details e- alternative treatments tried
4-must supply information in writing within 30 days
MR 54A
Sales of Medicines Registers
1- This regulation applies to sale of a medicines if
a- restricted medicines sold by retail not under prescription
b- prescription medicine, restricted medicine, pharmacy only sold by wholesale
2- Person who makes sale must
a- maintain sale register for recording information
b- information is kept in a way it can be conveniently inspected / retrieved
3- Register must be in one of the following
a- electronic system
b- writing in book
c- other system approved by director general
4- information required a- date of sale b- buyers name c- address of buyers place d- medicine sold e- quantity f- name of salesperson
MR 55
Records of sales of retail or wholesaler
1- before giving the buyer medicine whole sale regulation 54A (1) applies, person making sale must record in sale of medicine register maintained under regulation 54A (4) information can be found in sellers books and records
2- Not necessary to comply with (1) if sale by whole sale 54A (4) information can be found in sellers books and records
MR 56
Records of hawker sales
1- Person who hawks any prescription medicine or restricted or pharmacy only shall keep hawkers medicine book that records medicines that he hawk or as in possession
2- Each page shall be set out as (a) in schedule 4 and 1, form and strength of the medicine
3- legibly enters not later than the next ordinary business day it was sold
4- shall
(a) purchaser entitled to medicine
(b) obtain a printed request for medicine signed and dated
i- date of transaction ii- name of purchaser iii- address of purchaser iv- name of medicine v- quantity
MR 57
Record of supplies pursuant to prescriptions
1- Every person who dispenses or supplies medicines or restricted medicines pursuant to a prescription shall NO LATER than the next ordinary business day record supply in prescription register or as directed by DG
a- date of each transaction b- name of patient or owner of animal c- address d- name of medicine e- quantity f- name of prescriber g- unique identifying number or code
MR 58
Records to be kept
1- must keep for at least 3 years after it was made
2- must keep record
a- secure place at business or
b- other place that is authorised
