The elements of mens rea and actus reus are identified from any given scenario, and the criminal analysis method is applied to any given scenario to determine whether a charge can be proved.

A
The “Guilty Act” - the physical act or effort required to carry out the offence.

Define “Mens Rea”
A
The “Guilty Mind” - the intent: what was in the person’s mind that compelled them to undertake Actus Reus.

Explain how to apply the “Criminal Analysis Method”
A
Must prove 3 components: Actus Reus, Mens Rea and ingredients specific to the offence. All ingredients must be proved to bring a charge, so this must be kept in mind when collecting evidence.
