A

Planning/preparing to commit a crime or an attempt to commit a crime which is unsuccessful as the fail to complete AR

Where is preliminary defined in law and what is it defined as?

A

S1(1) Criminal Attempts Act 1981 - “if, with intent to commit an offence to which this section applies, a person does an act which is more than merely preparatory to the commission of the offence, he is guilty of attempting to commit the offence”

A

Triable on indictment offences including an either way offence via indictment (serious crimes) e.g ABH, GBH, S18 (with intent) and S20, theft, robbery, murder

A

What is the men’s Rea of an attempt?

A

Intent takes the same definition as the common law offence. This is the same intention which would be required for the full attempt. (R v Pearman 1984)

No intention, no offence (Easom 1971)
