Rule 1.0 Terminology
Belief: Actual belief inferred from circumstances.
Confirmed in Writing (CIW): Written consent or lawyer’s written confirmation of oral consent. Must be done promptly or within reasonable time.
Firm: Lawyers in partnership, corporation, or legal department.
Fraud: Conduct meant to deceive.
Informed Consent (IC): Agreement after risks and alternatives explained.
Knowledge: Actual knowledge inferred from circumstances.
Partner: Member/shareholder in a legal entity.
Reasonable: Conduct of a prudent lawyer.
RB (Reasonable Belief): Lawyer believes and it’s reasonable.
RSK (Reasonably Should Know): Prudent lawyer would know.
Screened: Isolated lawyer to protect confidential info.
Substantial: Material and significant.
Tribunal: Court or similar adjudicative body.
Writing: Any tangible/electronic record of communication.
