Misleading: Omits necessary facts, making it deceptive as a whole.
Rule 7.2 Communications Concerning a Lawyer’s Services: Specific Rules
- Communication Allowed: Lawyers can advertise through any media.
- Referral Compensation Limits:
No compensation for referrals, except:
Ad Costs: Pay for permitted ads.
Referral Services: Pay usual charges.
Buy Law Practice: Per Rule 1.17.
Reciprocal Referrals: Non-exclusive and disclosed.
Nominal Gifts: Small tokens, not for compensation. - Specialist Claims:
Only claim certification if:
Certified by an approved organization.
Name of certifying organization is stated. - Responsibility Info:
Include name and contact of lawyer or firm responsible for ad content.
Rule 7.3 Solicitation of Clients
Solicitation is a lawyer-initiated communication offering legal services to someone known to need them in a specific matter.
No Live Solicitation for Profit: No in-person solicitation for profit, except to:
- Lawyers.
- Family, friends, or prior relationships.
- Business users of such legal services.
Prohibited Solicitation:
Even allowed solicitations are prohibited if:
Target doesn’t want to be contacted.
Solicitation involves coercion, duress, or harassment.
- Legal Exceptions:
Permitted if authorized by law or court order. - Prepaid Legal Plans:
Allowed if part of a prepaid/group plan not owned or directed by the lawyer, targeting those not specifically needing services.
Rule 7.6 Political Contributions to Obtain Government Legal Engagements or Appointments by Judges
Don’t accept government legal work or judicial appointments if political contributions were made or solicited to secure such engagements.
