What does the notice for an alibi defense need to contain?
The notice must contain information about the place and time the defendant claims to have been at the time of the offense, as well as the names and addresses of any alibi witnesses.
When can a motion for dismal be filed?
A pretrial motion to dismiss must raise all available defenses, and must be presented before or at arraignment unless the court in its discretion permits a defendant additional time. Every ground for a motion to dismiss not included in the motion, except objections based on fundamental grounds, is deemed waived. However, the court may at any time entertain a motion based on certain specified grounds, including the grounds that there are no material disputed facts and the undisputed facts do not establish a prima facie case of guilt- C 4 motion like summary judgment.
