4 THE FOLLOWING ACTS
CONSTITUTE THE PRACTICE OF MEDICINE
(DTOP)
• Physically examine a person and diagnose
• Physically examine a person and treat
• Physically examine a person and operate
• Physically examine a person and prescribe any remedy

Medical diagnosis
a mental process whereby one or more persons appraise a situation and make a decision based on their judgment that may lead or may not lead to action
Diagnosis
is all the steps taken to affect a cure of an
injury or disease, includes examination and diagnosis,
application of remedies
Treatment
act or succession of acts performed upon the body of a patient for his relief or restoration of normal condition, either by manipulation or the use of surgical instruments or both
Operation
operation within or upon the following cavities: cranium, thorax or abdomen
Major Surgery
3 Cavities where “Major surgery” applies
- Cranium
- Thorax
- Abdomen
direction of remedy or remedies for a disease and the manner of using them to prescribe means to direct, designate or order use of a remedy
Prescription
The following 2 conditions do not affect the act as to be a
Practice of Medicine:
- Whether or not the act was done with or without compensation;
- Regardless of the nature of the remedy or treatment administered

8 TREATMENT NOT
CONSIDERED PRACTICE OF MEDICINE under provision of law
- Med students supervised by a registered physician
- Legally registered dentist practicing exclusively in dentistry
- Any duly registered masseur or physiotherapist, provided that he applies massage as per prescription or by the act itself ONLY
- Registered optometrist who mechanically fits or sells lenses
- Any person who renders service gratuitously in cases of emergency where no MD is available
- Any person who administers or recommends any household remedy as per classification of existing Pharmacy Laws
- Prosthetist who fit artificial limbs under the supervision of a registered physician
- Clinical psychologist or mental hygienist in regards to psychiatric cases

- Use of an electric machine by barbers in giving treatment
- The application of medicated massage was held not to constitute a practice of medicine
- hospital cannot be aid to be practicing medicine in violation of law where it merely agrees to care for the patient in the usual manner

Not exempted in the definition of acts constituting the
practice of Medicine

Founded more in mystery rather than science, “miracle cure”, balancing of energy forces in the body. Primarily concerned with the relief of pain when applied
ACUPUNCTURE
Rules imposed by the Philippine Medical Association on acupuncture
- Should be subject to the rules created by the Board of medicine
- Limited practice by physicians or approved practitioners
Regulates the practice of traditional medicine in the
Philippines (attached to DOH)
RA 8423 (Traditional and Alternative Act Of 1997)
A professional acupuncturist should be registered as a
→ Certified Acupuncturist (CA)
→ Certified Medical Acupuncturist (CMA)
PENALTIES FOR “ILLEGAL PRACTICE OF

- Foreign Doctors
- International bodies doctors
- USAF doctors
- Foreign exchange professor doctors
- Medical students who have completed the first four years of the medical course
Presidential decree allowing former Filipino professionals to practice their respective professions in the Philippines

4 “Balikbayan” Physicians qualifications
- Professional practitioners of good standing prior to their departure from the Philippines
- Registered with PRC and paid license fees
- Those qualified to practice by reciprocity agreements
- Medical students or graduates under training
