PRACTICE DIRECTION NUMBER 13 OF 2024
- When does the PD it apply? and
- What must a barrister do?
PD 13 of 2024 applies to a barrister who accepts instruction from a person who is not a solicitor (direct brief). This does not apply where a brief is accepted from a government legal officer.
A barrister who accepts a direct brief must:-
(1) comply with rule 24B
(2) prepare a document which (i) sets out matters required to be disclosed under r 24B (ii) have client sign document (iii) barrister sign confirming they have explained the complain process for professional conduct i.e. referral to LSC
(3) when the proceeding is commenced OR is the barrister is retained after the commencement at the time the next document is filed AND in any event before the barrister first appears in court…barrister must (i) file a copy of the document in the registry and (ii) deliver a copy to the bar association
