R 16 BCR prevents a barrister from practising as the employee of any person, however there is an exception to this…where the barrister engages in devilling. What is devilling and the rules about it?
r 107 - a barrister will not have breached rule 16 by carrying out a specific research or chamber task given by another barrister so long as:-
(a) the barrister who was briefed takes full responsibility for the work;
(b) the work is delivered under the name of the barrister who was briefed;
(c) the arrangement between the barrister does not go beyond an ordinary devilling or reading arrangement and does not involve any standing arrangement or employment terms;
(d) the arraignment between the barristers does not provide and is not intended to enable the barrister giving the task to make a profit from the other barristers work over and above reasonable remuneration for supervision and responsibility for the other barristers work
