Functions of the Police
PPPUD
Protect the community Preserve peace and good order Prevent offending Uphold the law Detect and bring offenders to justice
Assault
A person strikes, touches, moves or applies any force to another directly or indirectly without that persons consent
Bodily harm
bodily injury that interferes with persons health or comfort
Statute of limitations
Simple and Indictable offence without indictment - 12 months
Indictable offence with indictment - Nil time frame
What are factors that contribute to an Assault occasioning bodily harm
- Body harm is caused as a result of the assault
- Possession or pretends to be in possession of a dangerous weapon.
- With one or more persons
Factors for serious Assaults
- Assaults with intention to commit a crime
- Assaults or resist a Police in the execution of their duty
- Assaults person over 60
- Assaults person relying on assistant dog or wheel chair or other assistant device
- Assault from bodily fluids
Identifying Particulars
Police may serve an IPN for offences that carry a 1yr imprisonment. Must be served by written notice.
- the person must appear at the states Police station within 7 days.
- allow Police to take any of the persons identifying particulars, including photo
- stay at the Police station for a reasonable necessary for Police to obtain particulars.
What Particulars are obtain for an IPN
- Palm print
- Finger print
- Voice print
- Handwritting
- foot print
- photograph
DNA is not a requirement
Definition of a child
Child is an individual under the age of 18yrs
- Not criminally liable under the age of 10yrs, Between 10-14yrs accountability must be met
What are the important issues with evidence
- the Relevance and Admissibility of the evidence
