What legislation is used to protect vulnerable adults?
The Adult Support and Protection (Scotland) Act 2007
What are the main duties and powers under the adult support and protection act?
Councils duty to inquire and investigate where there are concerns
Duty to co-operate
How are adults at risk defined?
People over 16 who -
Are unable to safeguard their own well being, property, rights or other interests;
Are at risk of harm; and
Are more vulnerable as a result of their circumstances than adults who aren’t as affected
What are duties of cooperation?
Report facts and circumstances to local council for adult at risk who needs protection
Cooperate with council and each other to enable or assist council making enquiries
What is the Public Interest Disclosure Act 1998?
Protects individuals making disclosures that show health or safety of a person may be endangered
What are examples of people who may cause harm to adults?
Relatives and family members Professional staff Paid care workers Neighbours Friends and associates
