Under Section 32 of the Policing Act 2008 what particulars must a person in custody provide?
- Biographical details (Name, DOB, Address)
- Fingerprints, palm prints and footprints
- Photograph
Under Section 33 of the Policing Act 2008 when can you detain a person?
If you have good cause to suspect them of committing an offence and intend to summons them you may detain them for the purpose of obtaining particulars. (As now detained s32 also applies to them)
Under Section 33 where can you detain the person and for how long?
At any place for as long as required to take the identifying particulars.
How long can you detain someone for detox under Section 36 of the Policing Act 2008 ?
Until they cease to be intoxicated but no longer than 12 hours after first detained unless a health practitioner recommends longer.
Where must a person be to be detoxed under s36?
Public Place OR Trespassing on private property
What are the two preferred options before the cells for 1K persons?
- Home (with someone home to care for them)
- A temporary shelter
