Who must give details to any member of the Police under s40 Arms Act 1983?
Any person in possession of any firearm, airgun, pistol or restricted weapon must give name, dob and address to any constable.
What happens if a person refuses to give details under s40 Arms Act 1983?
Caution, then arrest if still refuses to give details.
If a firearm, airgun, imitation firearm, restricted weapon or explosive is found who is deemed to have possession of it under s66 Arms Act 1983?
Every person in occupation of that land or building or the driver of the vehicle in which the item is found unless they prove it was not his property and that it was in the possession if some other person. (Police must prove that the person is in fact the occupier for this to apply. Owning a building is not enough, they must be living there (Hepi v R))
