A

RGTS person committed offence and wanting to summons.

May detain that person at any place to obtain particulars. Time reasonably necessary to do so.

A person who, after being cautioned, fails to comply commits an offence and is liable to conviction of imprisonment 6 months and fine $5,000.

Section 36 of PA 1989 is the care and protection of intoxicated person. What does this section outline?

A

Intoxicated person found in PP or while trespassing on private property.

RGTB incapable of protecting themselves.
Likely to cause physical harm or damage property.
Constable satisfied not appropriate to take home or to a shelter.

May detain for up 12 hours or until no longer intoxicated.

Medical practitioner may recommend further 12 hours.
