Who can order a PSO?
Any constable with a qualified constable (sgt) or above
What is a bound person?
Who the PSO has been issued too.
What is an ‘at risk person’
Any person named in the PSO and and child residing with that person
What is the maximum timeframe of a PSO?
Any time up to 10 days.
The PSO must be served with in 48hrs of the incident.
When making a decision to serve a PSO or not, how long can police detain ?
2 hrs
What must be completed in order for a PSO a be active?
Authorisation from a qualified constable
Issue the order
Serve the order
If the person refuses to be detained. What may happen?
And what arrest power may be used?
The person has committed a $500 dollar fine
And
Failing to remain - section 32(2)(b) family violence Act 2018
Any bond person must surrender what to a constable?
Any weapons
Any firearm license
What happens if a PSO is breached?
There is no offence breaching a PSO.
Although if a constable believes it has reasonable grounds to do so the bound person may be brought before the district court.
