What is the relevant legislation and what does it control
The poisons act 1972- this was re-written by the deregulation act 2015
Control of poisons and explosive pre-cursors
State the 4 parts classified by the act
Part 1- regulated explosive precursors
Part 2- regulated poisons (p1+2 known as regulated substances)
Part 3- reportable explosives
Part 4- reportable poisons
(P3+4 known as reportable substances)
State some part 1 substance
Hydrogen peroxide- 12%<
Nitric acid- 3%<
Potassium chlorate- 40%<
Sodium perchlorate- 40%<
State some part 2 substances
Hydrogen cyanide (metal cleaning and electroplating) Lead acetates (painting, soldering and pottery) Barium salts (chemistry experiments)
State some P3 substances
Acetone Ammonium nitrate Calcium nitrate Hexamine Potassium nitrate Sulfuric acid
State some part 4 substances
Ammonia -10% Formaldehyde- 5% Hydrochloric acid-10% Alkali metal florides K and NaOH
What substances are NOT controlled by the act
Medicinal product for humans or animals
Any substance contained in a spesific object- the design determines the function more than the chemical composition
Cosmetics
General exemption: building products and adhesives
Special exemption: barium chloride in fire extinguishers
Who can have or sell regulated substances
Members of the public need a home office license to have part 1 (EPL)
Part 2 may only be sold from a registered pharmacy with the supervision of a pharmacist
Must check license when making any sales and check if foreign that it is recognised by GB
What to do when making a sale
Ask to see licence and photo ID
Compare photo ID to person
Verify the photo ID reference to that on the license, if different must refuse
It will say on the license what they can buy including conc and quantity
Must write on the license what they have brought
Affix statutory warning label or use by public is restricted
Record keeping- the 2 sets of records that apply to the regulated substances
1) record transaction on the license itself- for part 1+2
2) record kept within the pharmacy only for part 2 poisons and must be retained for 3 Years from date on last entry made in record
Recording on license for regulated substances
Date of supply
Name and address of the person
Name and quantity of the regulated poison
The purpose stated by the member of public
Signature of buyer
What are the rules of reportable substances
Sales don’t need a home office license
Can be supplied on request as long as the person doesn’t seem suspicious and there aren’t better alternatives
What are the storage conditions for reportable and regulated poisons
In a cupboard or drawer reserved solely for poison storage
In a part of the shop that is partitioned off or where costumers can’t get access to
No food or drink is kept directly under the poisons
What is a suspicious transaction
When there are reasonable grounds for suspecting that a substance in question is intended for
Illicit manufacture of explosives
Any illicit use
State some suspicious examples
Appears unclear about intended use of substance
Uncommon concentrations or quantities for private use
Unwilling to provide proof of identity or residence
Insists on large amounts of cash
