Define respondent and applicant
Respondent- The person receiving the PO
Applicant- The person issuing the PO.
Standard condition of a protection order
1 No violence- physical or sexual
2 Contect- no contact with the applicant
3 Weapons-
Law regarding the respondent suffering there firearms and licence to police.
Consider section 176 requires the police to consider using powers available under arms act.
Suspend the licence then revoked. Section 27.
Surrender firearms or if not surrender then breach of PO section 100 and 113
Identify how long if not challenged a PO becomes final.
After 3 months with no challenge PO becomes final.
Special bail requirements after arrest for breaching PO
Conditions of bail curfew provisions, non residency, non association clauses. Not interferences of employment.
Identify the power to search for and seize fire arms.
Section 18 of the s and s act
When there are grounds to make an application for a protection order
When prevention is needed preventing the respondent from engaging in violence.
