When does the “plea before venue” procedure occur?

A

When a defendant is charged with an either way offence - after their first appearance in the magistrates court.

NB- this process only occurs if the defendant indicates a not guilty plea.

A

It it believes that it has sufficient sentencing powers.

If not, the case will be sent to the crown court.
