What is NPPF?

A
  • National planning policy framework

Set out the Governments planning policies which set out the economic, environment and special legislation in England.

Was created to simply the planning system and it’s policies into one easily understood document and was last updated in 2019.

LPAs should use this when they are producing there development LDPs.

What is the hierarchy of he planning system in the UK?

A

National level
Local level

Scotland we still have strategic
level and in England there is also specially in London the GLA.

However most was abolished in the localism act 2011

What are development plans?

A

sets out the governments policy’s and planning strategy for economic environmental and special developments within a local authority area.
They must have public consultation before adopted by a LPA
They help guide day to day planning application decision
Used as rational and a threshold for development
Help guide Local development plans
- All Local authorities should have a development framework

What is the primary planning legislation in the UK?

A
  • In England it is the Town and Country planning act 1990. This provides to main legal basis / sets the structure for all planning policies within England.
  • Scottish equivalent is the Town and country planning act (Scotland) Which was amended in 2019 by The Planning Scotland Act 2019.

What is the difference between outline and detailed planning?

A
  • Detailed planning is the process in which you apply for development with full detail of the design, layout, materials, size, and all reserved type matters are decided at this time. once you have a detailed planning application approved you have the right to start the construction phase.
  • Outlined planning is the process which one will take if they want to check planning approval would be feesabible / likely. Outlined planning only needs to include information about what they want to propose, and access points. If outlined planning is approved it is allowing you then have to go through a full planning application called a reserved matters application before you have the right to build

What is the purpose of a conservation area?

A
  • Conservation areas are places of special architectural or historic interest where it is desirable to preserve and enhance the character and appearance of such areas.
  • For example a lot of Edinburgh City lies within a conservation area and there are special controls (called ‘Article 4 Directions’). These restrict work you can normally do without planning permission such as replacing a door or windows railings need to be black, windows must be sanshin case and trees within conservation areas are protected like TPOS.

What are simplified planning zones?

A

Areas in which the Local Authority give special permission to encourage planning without the need for a planning application or paying the planning application fees. These are normally areas to encourage new development which will boost local economy and make it more appealing to developers. SPZs can be found within the Local development framework.

What are reserved matters?

A
  • Reserved matters is an application with follows a successful outlined planning application. It is when all previous matters now must be submitted to make it a full planning application and gain a full content to build.
  • Reserved matters applications must include details on the following areas (try to remember as ‘L-A-S-A-L’):
  • LAYOUT – The layout of buildings within the proposed development.
  • APPEARANCE – The appearance of buildings.
  • SCALE – The precise height, width and length of individual buildings.
  • ACCESS – Access to and within the site for vehicles, cycles and pedestrians.
  • LANDSCAPE – Landscape proposals.
