UNLAWFUL CARRYING OF A PISTOL

A

ELEMENTS:

  1. Law Enforcement Officers may carry open or concealed.
  2. Armed forces/National Guard members may carry open or concealed.
  3. Members, and their invited guests, of gun clubs may carry open or concealed while at or going to or from places of target practice, or their shows or exhibits.
  4. Licensed hunters or fishermen, while engaged in hunting or fishing, can carry open or concealed while going to or from those places while in a vehicle or on foot.
  5. Gun dealers or Gunsmiths may carry open or concealed in the usual or ordinary course of the business.
  6. Guards at Federal properties may carry open or concealed when engaged in protection of property of the U.S. or any U.S. agency.
  7. Military or civil organizations may carry open or concealed while on parade or going to or from places of meeting.
  8. Persons at home or on their real property, or with owner permission of real property, may carry open or concealed.
  9. An unlicensed person may carry a stored handgun in a closed glove box, trunk, or console that is secured by integral fastener.
  10. A licensed person may carry concealed weapons by permit, on his person, any open or closed storage compartment, or under a seat in a vehicle.
  11. A prison guard may carry open or concealed while engaged in official duties.
  12. Owners of a fixed place of business may carry while at the fixed place of business, but only after acquiring a special permit and permission to do so.
  13. Firearms trainers, firearms related businesses that sell, repair, pawn, etc., may carry.
  14. Any person on a motorcycle, when pistol is secured in a closed saddlebag or similar, may carry.

SALE OR DELIVERY OF A PISTOL TO CERTAIN PERSONS; POSSESSION OF A PISTOL BY CERTAIN PERSONS - IS UNLAWFUL - BY

ELEMENTS:

  1. any person convicted of a crime of violence, fugitive of justice, habitual drunkard, drug addict, or adjudicated mentally incompetent.
  2. any person who is a member of a subversive organization
  3. any person under the age of 18 (certain exceptions apply - armed forces, nat. guard)
  4. any person adjudicated unfit to carry a pistol
  5. unlawful for any person above to possess or acquire pistols in this state
  6. no person shall knowingly buy, sell, transport, pawn, receive, or possess and stolen pistol, or one with the serial number removed or obliterated.

ELEMENTS: An accused..

  1. unlawfully discharges/causes to be discharged
  2. firearms at or into
  3. a dwelling house, other building, structure or enclosure regularly occupied by persons

OR

    1. and 2. above PLUS…
  1. any vehicle, aircraft, watercraft or other conveyance, device, or equipment while occupied.
