Criminal Procedure: Trail by jury
Bond waived his right to be trailed by a jury(6th amendment) b/c the jury may not understand why he would shoot the car with his daughter in it
Concurrent Sentences
CA: Sentences are concurrent
Federal court: Consecutive unless stated otherwise
specific intent to kill
Attempted involuntary manslaughter=oxymoron/no crime
Attempted voluntary manslaughter=crime /Heat of passion
ALL attempts are SI crimes and are not reckless
Intentional risk v. intentional harm
Murder does NOT require the SI to kill but Attempot does
Attempted Assault
Depends. If you intended to place another person in immediate fear or injury, but never did that would be the same as attempted attempt. Which is hard to prove.BUT
If the attempt was made but failed b/c of faulty planning, but the person was still in fear then YES.
-EX: Attempted DUI, you out keys in ignition but friend takes it away
Self-defense?
NO. A brick is not porportional or equivalent to the firing of a gun. Firing a gun was an over reaction
