Attempted Assault

A

Depends. If you intended to place another person in immediate fear or injury, but never did that would be the same as attempted attempt. Which is hard to prove.BUT
If the attempt was made but failed b/c of faulty planning, but the person was still in fear then YES.

-EX: Attempted DUI, you out keys in ignition but friend takes it away

NO. A brick is not porportional or equivalent to the firing of a gun. Firing a gun was an over reaction
