Define “Abets”
To instigate or encourage to commit an offence
Define “Incites”
To rouse or stir up another person to commit an offence
Define “Aids”
To assist in the commission of the offence, either physically or by giving advice or information
When must participation have occurred?
Participation must occur before or during the commission of the offence and before the completion
Define “Counsels”
To intentionally instigate the offence by advising how to best commit it
What must be proved by prosecution?
- IDENTITY of the defendant, AND
- An offence has successfully been committed, AND
- The ingredients of the offence (s.66(1)) has been satisfied
Define “Procures”
Is setting out to see that something happens and taking the appropriate steps to see it happen
List the ingredients for Parties
Actually commits the offence
Does or omits an act for the purpose of aiding any person to commit the offence OR
Abets any person in the commission of the offence
OR
Incites, counsels, or procures any person to commit an offence
Provide examples of assistance?
- Keeping a lookout at a burglary
- Providing a screw driver to someone breaking into a car
- Telling an associate when a neighbour is away to allow opportunity to commit burglary
What is the case law for when the “intention to help or encourage must exist”
R v Pene
A party must intentionally help or encourage
It is insufficient if they were reckless as to whether the principal was assisted or encouraged

Person another to drive. That person has a legal duty to ensure reasonable precautions are taken to prevent accident occurring or any danger to public.
