Either the formation or performance of the bargain was criminal or tortious or contrary to public policy. Illegal contracts are void. Then courts refuse to enforce it, and they also strike down immoral, unconscious, unprofessional, or unjust contacts

Allow the innocent one to recover if you can show readiness, willingness, and ability to perform but for the illegality. Ie: married man trying to marry another woman who didn’t know he was married
