Conservatee
Person who is unable to manage personal care &/or finances
Conservator
a person or org chosen to protect & manage the personal care &/or finances of someone unable to do so

When does a conservator file a petition?

Types of Conservatorships
- Probate - most common type - can be general or limited
a. General - adults who can’t handle own finances or care for themselves
b. Limited - set up for adults with developmental disabilities who can’t fully care for themselves but dont need higher level like general
Lanterman-Petris-Short (LPS) Conservatorships
1969 law
Created to arrange for certain kinds of very restrictive living arrangements & extended mental health treatment for people unable to provide for their own needs for food, clothing, shelter as a result of mental disorder or chronic alcholism & who can’t or won’t agree to
arrangement voluntarily.
APPOINTMENT IS THRU COUNTY PUBLIC GUARDIAN or gov agency. more $$.
Qualify to serve as Conservator
Licensed, acknowledge duties & liabilities, Obtain a bond, sign an oath perform according to the law, file papers with court
Letters of Conservatorship
Shows your authority to act as conservator - need certified copy of letters to act as c.
Court investigator
Court sends out to see conservatee
Changing Conservators or ending Cship
when cee dies, judges ends or appoints someone else
