**Overview

A

236 years since colonisation - by British on First Nations who were not asked to give up their land

Thus begun DISPOSSESSION of First Nations way of life, tradition, customs, lore. Introduced diseases took devastating toll on health of FN.

Frontier wars, tens of thousands of FN killed.

123 years since Queensland became its own State

Following on with State laws that legislated forcible movement of First Nations people from country to exile, separation and removal of children from families, 1960s FN given right to vote but not compulsory until 1980s.

Unfair wages.

Not given self-direction in making of laws. Ie most recent DV reforms, lack of proper consultant has meant an even bigger detrimental effect on FN.

This has resulted in eduction gap, health gap, generation poverty and overrepresentation within CJS. Disproportionately higher level of deaths in custody. As a result of INTERGENERATIONAL TRAUMA & SYSTEMIC RACISM.

**What is a treaty and why do we need one?

A
  1. Legally binding agreement
  2. Recognise wrongs
  3. Provide an opportunity to recast relationship between FN and non-FN peoples

for Qld it is about (treaty themes):

  1. INCLUSION the Qld Govt and A/TSI peoples coming together as equals to write our future together
  2. RECONCILIATION building a shared understanding of the past so we can build a strong and equal future based on respect
  3. TREATY READY supporting all Queenslanders to participate in a process that promotes healing, justice and reconciliation

**Cultural capability training

A
  • the QPS has not provided its staff with appropriate cultural capability training about colonisation and the impacts of the historical and contemporary relationships between First Nations communities and police
  • currently being rolled out via recruit training, soon to be state-wide
  • involves FN trainer and non-indigenous trainer

**FN Division / TT & H Inquiry Response Team - about

A

FND was established to build culturally responsive internal and external policing strategies = create a culturally inclusive, culturally responsive and culturally capable QPS

TT&H Inquiry Response Team:

1.support work associated with QPS response to Inquiry and FN community engagement over next three years

  1. Provide high quality advice on Inquiry matters likely to affect the provisions of policing service to Qld FN communities
  2. provide advice regarding culturally capable operational policing to Inquiry Response Team members to inform the preparation of responses to Inquiry requests

**PTT Act Main Purposes

A

a) establish FN Treaty Institute to
i) develop and provide framework for A/TSI peoples & the State to enter treaty negs; and
ii) support A/TSI peoples to PARTICIPATE in treaty negs; and
b) provide for establishment of Truth-telling & Healing Enquiry to inquire into & report on impacts of colonisations on FN and history of the State

**PTT Act - Principles for administering Act

A

1) ensure that, in partnership and good faith, the rights and history of A/TSI peoples are acknowledged and respected in accordance with:
a) Human Rights Act; and
b) the principles of the UN Declaration on the Rights of Indigenous Peoples
2) + the following principles apply:
a) the importance of self-determination for A/TSI peoples;
b) importance of A/TSI peoples being able to give free, prior and informed consent as part of treaty negs and the making of a treaty;
c) the importance of respecting and protecting A/TSI law, tradition and customs
d) the importance of equality and non-discrimination
