Tennessee follows federal law except:
1.) Must be 18 or older to purchase.
2.) Sold only in licensed pharmacies.
3.) Products are kept behind the counter or in a locked case within view of and 25 ft. from the counter.
4.) The pharmacy cannot sell more than 5.76 g in 30 consecutive days, or 28.8 g in any one-year period to the same person.
Does the state require the submission of pseudoephedrine sales to NPLEx?
Yes, it must be submitted before completing the sale.
Products cannot be sold if a “stop sale” alert is generated by NPLEx. If mechanical or electronic failure occurs, the pharmacy must keep a written log and enter the information into the database when the system becoming operational again.
Individuals convicted of a methamphetamine-related offense are not allowed to purchase any quantity of precursor products for 10 years and will generate a “stop sale” alert by NPLEx.
What are the requirements for selling dextromethorphan?
The purchaser must be ≥ 18 years old
The pharmacy/seller must ask for valid government-issued photo identification proving that the purchaser is at least 18 years of age, unless the seller reasonably believes that the purchaser looks at least 30 years old or if the minor can provide proof of emancipation.
