IDEA
IDEA guarantees that children with disabilities be educated in LRE ( Least restrictive environment). Children with disabilities are most appropriately educated with their non-disabled peers. Whatever the disability, the “first student placement” should be considered – assign child to general education classroom with appropriate supports and aids. Many students are placed in general education classrooms with support from special education programs and related services .
The Rehabilitation Act of 1973-civil rights law
- protects all recipients of federal funds (for example SEA or LEA’s)
- Section 504 eligibility guarantees FAPE, nondiscrimination testing, placement in LRE and due process
- Requires a written educational accommodation plan (504 plan) to any student who meets the definition of disabled and requires modification
- we provide modifications or accommodations under 504 but we do not provide services under 504.
- All school ages qualify for the 504- but must have a medical diagnosis- college students included as well.

- ages 3-21
- OTs viewed as a related services to support child’s educational needs (further defined OT role and responsibilities as service provider in schools
No Child Left Behind (NCLB)
Accountability and child learning outcomes, changes to general and special educators and service providers working in schools. New standard for “highly qualified” special education teachers.

ESEA- elementary and secondary education Act
focus federal law is for all children
-standards are used as content guide the education/curriculum for students with disabilities
ESSA- Every Student Succeeds Act
- replaced the ESEA commonly referred to as NCLB
- requires all students to be taught high academic standards
- Provides protection for America’s disadvantage and high need students
- Increases access to high quality preschools
- Expects accountability and action in low performing schools.

SISP- specialized instruction support personnel
- includes related service providers
- State and LEA’s are charged with conducting “timely and meaningful consultation with SISPs”
- OTs are recognized as SISPs in the ESSA and can open up opportunities for us to provide further services.
3 main roles of OT in school setting
- help student participation in general education or special education curriculum.
- inclusion, facilitate inclusion of children with peers during all aspects of the child’s day.
- we need to prepare and transition students with special needs to obtain gainful employment, independent living, post school

- it is an IDEA law requirement for a child to receive an educational diagnosis
- 60 calendar days to complete evaluation
Purpose of IEP
Legal document defines students educational programming and services
IEP should ensure FAPE, emphasizes the special education and related services required to meet.
(unique student needs and prepare for employment and independent living (not just skill development)
*Ensures rights of children and their parents are protected
School team is mandated to offer and provide parents a copy of procedural safeguards at every IEP meeting to ensure parent of their rights during the process of developing and IEP for their child

*Present level summary will include child’s unique needs and should be specific, objective and show measurable baseline information. Annual goals and objectives should reflect the needs of student based on summary information in the Present level of Academic and Functional Performance (PLAAFP).
