Section 42? OT
Search without warrant - allows police to enter and remove or detain children or young people if deemed critically necessary to prevent injury or death
Section 39? OT
Place of safety warrant - believe it is necessary to remove or detain a child however not critically necessary at that time
What are the obligations under section 42? OT
Must produce ID
State you are using the Oranga Tamariki Act and powers are under 42.
Must inform commissioner within 3 days of the use of the power
Police policy: must inform commissioner prior to end of shift
Section 48? OT
If a child is found unaccompanied, and potential for physical or mental health to be impaired exists, police may take the child or young person back to parents with consent, or if no consent is given, to the care of Oranga Tamariki
What is the definition of “child” in relation to care & protection
Child means person under age of 14yr
To be criminally responsible for burglary an offender must be how old
At least 14th s unless previous same convictions, then 12-13
