(c) Active duty or reserve may waive requirements and retired license may seek reinstatement

(6) Being negligent in practice of psychology
(7) Inability to practice: mental, emotional, physiological, pharmacological condition or substance abuse;
(8) Violating any rule of professional conduct promulgated by the board
(9) Practicing in an untrained or incompetent area;
(10) Adjudication by court is incompetent for holding the license.
- May have license issued or restored only upon determination by court competence
(11) Waiving payment of all or any part of a deductible or copayment
(12) Advertising waiving of payment

(2) Issue a reprimand to a license holder;
(3) Suspend the license of a license holder;

(5) Limit or restrict the areas of practice of an applicant or a license holder;
(6) Require mental, substance abuse, or physical evaluations, or combination
(7) Require remedial education and training

B) Practice of psychology includes but not restricted to (definition and 3 other points

  • the use of the title “psychologist” and/or the exercise of the professional judgments of diagnosis, psychological prescription, or client supervision.
    (1) “Psychological or school psychological diagnosis:” determination, after study, analysis, and description, that a problem is a psychological problem.
    (2) “Psychological or school psychological prescription:” determination of which psychological procedures should be applied for the prevention, treatment, or amelioration of psychological problems.
    (3) “Psychological or school psychological client supervision:” determination of when, in what sequence, and to what degree treatment be initiated, continued, or discontinued.
  • May include determining prescribed medications helpful in alleviating symptoms and referring to physician for prescription medication(s) if in the best interest of the client.
  • When prescribed medication, psychologist may evaluate and monitor the psychological effects to determine the psychological effects, in consultation with prescribing physician.

OAC 4732-5-02 Exemptions from licensure requirements (10)

A

(A) Holds license issued by the state board of education while practicing school psychology within the scope of employment by a board of education or by private school
-Under this division cannot offer psychological services unless licensed by the state board of psychology;
(B) Nonresident temporarily employed to render psychological services ≤30 days a year and submitted board-prescribed application and holds license or certificate to practice in home state/country;
(C) Any working under supervision of psychologist while engaging in training experiences
(D) Student carrying out supervised activities part of prescribed course of study
(E) Recognized religious officials conducting counseling within their scope
(F) Employ by federal government
(G) Licensed, certified, or registered in another provision than Chapter 4732
(H) Persons using the term “social psychologist,” “experimental psychologist,” “developmental psychologist,” “research psychologist,” “cognitive psychologist,” and other terms used in academic and research settings who possess a doctoral degree in psychology
(I) Teaching provided it does not involve professional practice of psychology in which student or client welfare is directly affected;
(J) Conducting research in the field of psychology, provided it does not otherwise involve the professional practice of psychology in which student or client welfare is directly affected.
