A
A duty of common humanity, so should not be injured by dangerous state of premises (Keown)

The occupier will ONLY owe the duty if: (3 points)
A
- he is aware of danger or has reasonable grounds to believe it exists (Rhind v Astbury Water Park)
- knows or believes a trespasser is in, or may come into the vicinity of danger (Donoghue v Folkestone)
- The risk is one against which, he may reasonably be expected to offer the other (trespasser) some protection
