Who makes up the commission board?
- Director of Public Safety, or designee (non-voting member)
- Superintendent of Highway Patrol, or designee (voting member)
- 12 other voting members appinted by the governor:
- 3 owners/operators of Class A business
- 1 owner/operator of Class B business
- 1 owner/operator of Class C business
- 2 owners/operators of Class A, B, or C business
each of above must have 5 years experience in the state - 1 Chief of Police
- 1 active LEO, not above rank of Lt.
- 1 Sheriff
- 2 members of general public without ever having any direct relationship with Class A, B, or C licensee
How long do commission members serve?
5 year terms, no more than 2 consecutive terms
How often does the commission meet?
A minimum of 4 times per year and as directed by the chairperson, the Director of Public Safety, or upon the request of 5 voting members.
Who elects chairperson and vice-chairperson?
Elected by commission at first meeting of the year.
How long does chair and vice-chair serve?
No more than 3 years of 5 year term
How many is a quorum?
7 members constitutes a quorum. A meeting must not be held unless a quorum is met. Cannot vote by proxy.
Are commission members reimbursed for expenses incurred while performing official duties?
Yes. Travel, hotel, etc.
Who funds the commission?

Does the commission have liability?
No, unless made under fraud or bad faith.
What are the requirements to obtain a license to operate?
- Must have good reputation for integrity, has not been convicted of a disqualifying offense within last 3 years, or any crime of moral turpitude.
- Must have 2 years immediate experience depending on the class of license.
- Must pass examination (not required to take additional officer level exam)
- Submit evidence of comprehensive GL insurance of $100K per person, $300K per injury, and $100K for property.

What are examples of a disqualifying offense?
an offense that is a felony and has a direct bearing on the fitness or ability of the individual to perform one or more of the duties or responsibilities
What is a crime of moral turpitude?
an attempt or conspiracy to commimt murder, a sexually oriented offense, a violent felony, or anthing similar under any other governing body
What must accompany the application for a license to operate?
Full face photo, 5 references, exam fee of $25, and fingerprints
What is a conditional license?
A license that is good for 1 year if an applicant has a criminal past that doesn’t disqualify him/her from applying.
When do company licenses expire?
Every year on March 1st
How to obtain a duplicate copy of the company license?
Pay fee up to $25 for lost, destroyed, etc. license
Can one person represent more than one company?
Yes, as long as he is active in both.
Can a company license be transferred to another corporation?
Yes, upon written notification with a $25 fee provided that the QA is the same.
What happens if I quit?
Notify Director via certified mail within 10 days, submit new name within 30 days, license good for 90 days while new person goes through application process.
Tell me about the fingerprint records.
A continuous record monitoring service will alert the department of public safety if an individual is arrested, convicted, or pleads guilty to any offense.
What reason can licenses or registrations be revoked, suspended, or refused?
Operating without a license, pretty much anything illegal, perjury, failure to complete application process,.
Can a company or person be fined for working without a license?
Yes. Up to $100 per day.

Report branch office locations to the department of public safety, to the sheriff of the corresponding county, and to the police chief of the municipality. Must post a branch office license conspicuously as well.
How do I get a branch office license?
Apply with the director of public safety and pay a fee of up to $100.
What if we switch offices?
Notify director, sheriff, and chief within 48 hours.
When do I submit a new employee’s application for registration?
No sooner than 3 days before hire or no later than 7 days after hire.
What must accompany a new employee’s application?
A recent photo, physical description, and registration fee of up to $40.
How does a new employee get fingerprinted?
Submit to superintendent of the bureau of criminal idnetification
How much is a replacement identification card?
$5
What is on the employee’s identification card?
License number and signature of licensee, employee’s name, address, age, physical description, right thumb print, photo of employee, and employee signature
Can an employee begin work without their card?
Not unless the card is pending and a waiver is received.
What does an armed employee have to do?
Complete 20 hours of handgun training and 5 hours of other firearms training if any other firearm is to be used, or equivalency training. Turn in certificate of completion, file an application for registration, receive a firearm-bearer notification on guard card, and qualify annually.
When does an employee’s card expire?
Annually on the anniversary date of issuance.
How are fines that are collected by the department of public safety for licensee penalties distributed?
1/3 to municipality that infraction took place
1/3 to county
1/3 to private investigator and security guard provider fund
Can firearms training be waived?
If proof of substantial training has been completed within 3 years.
Who receives the application for a fire arm permit?
The director of public safety, along with a $15 fee
Non-resident licenses and registration
An applicant for registration or license may be waived the exam by the director.
Child support default
A license may be denied, suspended, or revoked.
Penalties
A.) Operating without a license: 1st degree misdemeanor for first offense, or 5th degree felony if more than one offense. If two or more fined $10K and up to 1 year in jail.
B, C, or D.) $100-$1K fine and up to one year in jail
