What are the elements of theft?

What does dishonestly mean?
Without a belief that there was consent or authority from the owner
What is meant by without claim of right?
No belief in a right to own or possess the property
What does ‘takes’ cover
For tangible property, physically moving the property or causing it to be moved
What is covered in ‘Any property’
Anything whatsoever, either tangible or intangible, that is the property of another person and has value
What are the two things covered in ‘Intent to deprive the owner permanently of that property’?
1/ An intent to deprive the owner permanently of that property
2/ deal with the property in a manner so that it cannot be restored to its original condition

What is meant by ‘uses or deals with’
Exceeds the authority or conditions given by using or dealing with the property in any manner
What does it mean by ‘after obtaining possession or control of the property in whatever manner’
Legally obtained possession or control of that property for himself/herself or any other person
Where would you find the definition of dishonestly, and what does it state?
Section 217 of the Crimes Act
‘Dishonestly’ in relation to an act or omission, means done or omitted without belief that there was express or implied consent to, or authority for, the act or omission from a person entitled to give such consent or authority.
What is covered in claim of right?
