  2. A fire is considered suspicious

Fire scene safety

What are some Hazards?

Tip. 7 types. 3,3,1

A

Investigators search through unstable structure and excavating the scene to identify the cause of the fire.

Some of the hazards:

  • Inhalation of toxic substances
  • Ingestion of particles
  • Air Bourne dusts particles
  • Tripping on debris
  • Falling down over or onto obstructions or cavities
  • Items above falling on you or hitting objects causing a chain reaction
  • Cuts/wounds from sharp objects

TIP, 3 Breathing types, 3 tripping/falling types, 1 cutting. 3,3,1.

To protect yourself an assessment of the above risks needs to be taken. A strategy to prevent an occurrence or to mitigate its impact for protection from the risks.

How to prove recklessness?
(One subjective, one objective test)

A
  1. The defendant consciously and deliberately ran a risk (a subjective test)
  2. Risk is unreasonable in the circumstances as they were known to the defendant (objective test - whether a reasonable person would have taken the risk)
