What are the requirements for promissory estoppel?

A
  • pre existing contract or legal obligations which is then modified (Combe v Combe - wife tried to use as a sword)
  • a clear and unambiguous promise which can be implied through conduct (Woodhouse)
  • a change of position (Alan v El Nasr)
  • it must be inequitable to allow the promisor to go back on their promise (D&C Builders v Rees)

What is promissory estoppel?

A

An equitable doctrine which stops a person going back on a promise that is not supported by consideration (developed in High Trees).
