Is here a presumption to be bound in domestic agreements?
A
No (Balfour v Balfour) however agreements made between spouses not living together can be (Merritt v Merritt; Errington v Errington).

Are social agreements binding?
A
No but it can be rebutted (Simpkins v Pays - lived together and decided to split prize money if won).

Are commercial agreements binding?
A
Yes (Esso v Customs and Excise) but they can also be rebutted (Rose & Frank v Crompton Brothers - written in contract that it was not a legal agreement).

A
