S.39 Criminal Justice Act
Assault: definition
“An act which causes the victim
to apprehend the infliction of immediate unlawful force.”

• Words can be written or verbal - R v Constanza (1997)
• Silent calls can constitute an assault - R v Ireland (1997)
Assault: apprehend
• As a result of the act, the victim must fear that unlawful force will be used against them
• R v Logdon (1976): must fear some sort of force
• R v Lamb (1967): Pointed an unloaded gun at someone who is aware does not result in an assault
Assault: immediate unlawful force
force must be unlawful and immediate
• immediate does not mean instant: Smith v Woking (1983)
Assault: mens rea
• Intention to cause fear
• Recklessness which caused fear
