Can you give some examples of secondary options you included within your NEC contract for WHBG?
X7 - Delay Damages of £25,000 per week
X8 - Undertakings to the client or others
X15 - The contractors design
What are Z clauses?
Z clauses are amendments to the core clauses within the NEC, contract amendments essentially
What are dangers with Z clauses?
Dangers being that poorly drafted Z clauses could be problematic if they do not work well with the standard core clauses already within the contract
What is ‘Scope’ in NEC4 ECC contracts
Refers to extent and boundaries of the works that is required to be performed under the contract. Defines specific activities and deliverables the contractor is responsible for. Clients requirements such as design, drawings and spec.
How do you make an NEC contract D&B?
Design responsibility is set out in the ‘scope’, therefore if a D&B arrangement is required, it should be specified within the scope that all works are to be designed by the contractor
What is site information in NEC4 contracts?
Site information describes the existing and present conditions of the site e.g. survey info, existing as built drawings etc
can you outline the valuation process for WBHG
Contractor was to issue their application for payment on or before Assessment Date
From the assessment date, the PM had 7 days to issue the payment certificate (due date). After that, the client would have to pay the contractor 14 days after the payment certificate date (21 days after assessment date)
Role of a supervisor in NEC?
basically a CoW, assesses quality, notifies contractor of any defects
Can the supervisor and PM be the same person
Yes on smaller projects like WHBG and BHS this happened.
