2:1. הֲרֵינִי נָזִיר מִן הַגְּרוֹגָרוֹת וּמִן הַדְּבֵלָה, בֵּית שַׁמַּאי אוֹמְרִים, נָזִיר, וּבֵית הִלֵּל אוֹמְרִים, אֵינוֹ נָזִיר. אָמַר רַבִּי יְהוּדָה, אַף כְּשֶׁאָמְרוּ בֵית שַׁמַּאי, לֹא אָמְרוּ אֶלָּא בְאוֹמֵר הֲרֵי הֵן עָלַי קָרְבָּן:

What are the 2 ways of explaining the opinion of בית שמאי?

  1. Tana Kama: Beis Shamai holds of 2 principles.
    a. Ein odom motzee devorov levatoloh. A person means what he says.
    b. Hekdesh beta’us shemei hekdesh. One cannot renege on a hekdesh commitment. He accepted nezirus and then changed his mind by stating that he would be a nazir from dried or pressed figs, hoping to cancel his vow of nezirus. His vow still remains in effect and he is a standard nazir.
  2. Rabbi Yehuda: Bais Shamai agrees with Bais Hillel that he is not a nazir. But B.S. says that he can be understood as taking a vow to abstain from figs. We view his statement as if he said :let figs be prohibited to me like a korban and the standard law of vows applies.

Bais Hillel looks at the statement in its entirety as a single unit and it doesn’t make sense as figs are permitted to a nazir. Therefore he is not a nazir. We do not interpret his statement as a vow (like a korban) because he didn’t say that.

2.2 אָמַר, אָמְרָה פָרָה זוֹ הֲרֵינִי נְזִירָה אִם עוֹמֶדֶת אָנִי. אָמַר, הַדֶּלֶת הַזֶּה הֲרֵינִי נָזִיר אִם נִפְתָּח אָנִי. בֵּית שַׁמַּאי אוֹמְרִים, נָזִיר, וּבֵית הִלֵּל אוֹמְרִים, אֵינוֹ נָזִיר. אָמַר רַבִּי יְהוּדָה, אַף כְּשֶׁאָמְרוּ בֵית שַׁמַּאי, לֹא אָמְרוּ אֶלָּא בְאוֹמֵר הֲרֵי פָרָה זוֹ עָלַי קָרְבָּן אִם עוֹמֶדֶת הִיא:

This is a strange mishna. Similar to mishna 1.

  1. T.K. - B.S. holds that he made a statement which is accepted and the retraction is not accepted. B.H. says the statement is meaningless.
  2. Rabbi Yehuda - B.S. agrees that the statement is meaningless with regard to nezirus but the cow or the door becomes asur like a korban.

2:3 מָזְגוּ לוֹ אֶת הַכּוֹס, וְאָמַר הֲרֵינִי נָזִיר מִמֶּנוּ, הֲרֵי זֶה נָזִיר. מַעֲשֶׂה בְאִשָּׁה אַחַת שֶׁהָיְתָה שִׁכּוֹרָה וּמָזְגוּ לָהּ אֶת הַכּוֹס, וְאָמְרָה הֲרֵינִי נְזִירָה מִמֶּנּוּ, אָמְרוּ חֲכָמִים, לֹא נִתְכַּוְּנָה אֶלָּא לוֹמַר הֲרֵי הוּא עָלַי קָרְבָּן:

Principle: Person making a statement about one cup of wine (but not wine in general) becomes a complete nazir. This is only if he was sober at the time of his statement. But, if he was drunk, he is not a nazir.

The mishna, in support of this principle, brings the case of a drunk woman making such a statement over a single cup of wine where she does not become a nazira. We treat her statement as if she said the cup of wine should be asur to me as a korban.

2:4 הֲרֵינִי נָזִיר עַל מְנָת שֶׁאֱהֵא שׁוֹתֶה יַיִן וּמִטַּמֵּא לְמֵתִים, הֲרֵי זֶה נָזִיר וְאָסוּר בְּכֻלָּן. יוֹדֵעַ אֲנִי שֶׁיֵּשׁ נְזִירוּת אֲבָל אֵינִי יוֹדֵעַ שֶׁהַנָּזִיר אָסוּר בְּיַּיִן, הֲרֵי זֶה אָסוּר. וְרַבִּי שִׁמְעוֹן מַתִּיר. יוֹדֵעַ אֲנִי שֶׁהַנָּזִיר אָסוּר בְּיַּיִן אֲבָל סָבוּר הָיִיתִי שֶׁחֲכָמִים מַתִּירִים לִי מִפְּנֵי שֶׁאֵין אֲנִי יָכוֹל לִחְיוֹת אֶלָּא בְיַּיִן, אוֹ מִפְּנֵי שֶׁאֲנִי קוֹבֵר אֶת הַמֵּתִים, הֲרֵי זֶה מֻתָּר. וְרַבִּי שִׁמְעוֹן אוֹסֵר:

Principle_1: One cannot accept nezirus on the condition that some of the restrictions won’t apply (such as I will be a nazir but still drink wine and contact the dead). This is because nezirus is a package deal and one can’t place conditions that contradict the laws of the Torah.

Principle_2: Ignorance of a prohibition of nezirus (I didn’t know that wine was forbidden) doesn’t remove the vow of nezirus. This is opinion of the Chachomim. Rabbi Shimon disagrees, and annuls the nezirus.

Principle_3: If the consequence of the vow is unbearable (I must drink wine, I bury the dead) the vow never takes effect. This is opinion of the Chachomim. Rabbi Shimon disagrees, and he becomes a nazir until the nezirus is annulled by a sage.
