كَانَ رَسُولُ اللَّهِ صلى الله عليه وسلم يَقْطَعُ السَّارِقَ فِي رُبْعِ دِينَارٍ فَصَاعِدًا.
The Prophet SAWS used to cut the hands whoever steal in 1/4 dinar or more
“ لَعَنَ اللَّهُ السَّارِقَ يَسْرِقُ الْبَيْضَةَ فَتُقْطَعُ يَدُهُ وَيَسْرِقُ الْحَبْلَ فَتُقْطَعُ يَدُهُ ” .
Allah curses whoever steals, even if he steals an egg so his hands will be cut off, even if he steals a rope his hands will be cut off.
أَنَّ قُرَيْشًا، أَهَمَّهُمْ شَأْنُ الْمَرْأَةِ الْمَخْزُومِيَّةِ الَّتِي سَرَقَتْ فَقَالُوا مَنْ يُكَلِّمُ فِيهَا رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالُوا وَمَنْ يَجْتَرِئُ عَلَيْهِ إِلاَّ أُسَامَةُ حِبُّ رَسُولِ اللَّهِ صلى الله عليه وسلم . فَكَلَّمَهُ أُسَامَةُ . فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ” أَتَشْفَعُ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ ” . ثُمَّ قَامَ فَاخْتَطَبَ فَقَالَ ” أَيُّهَا النَّاسُ إِنَّمَا أَهْلَكَ الَّذِينَ قَبْلَكُمْ أَنَّهُمْ كَانُوا إِذَا سَرَقَ فِيهِمُ الشَّرِيفُ تَرَكُوهُ وَإِذَا سَرَقَ فِيهِمُ الضَّعِيفُ أَقَامُوا عَلَيْهِ الْحَدَّ وَايْمُ اللَّهِ لَوْ أَنَّ فَاطِمَةَ بِنْتَ مُحَمَّدٍ سَرَقَتْ لَقَطَعْتُ يَدَهَا ”
Indeed there was concern from the Quraish about a matter about a women from Makhzumi who stole. so they said: who will go and inform the prophet saws? so they said: “Who is more brave do you think except usama, he is more beloved to Rasuallah,So usama spoke, Rasuallah SAWS Said: Are you seeking intercession regarding her punishment from the punishment of allah? then he stood and delivered a sermon and he said: “ Oh People, the people before you have been destroyed when they would steal. if he were noble they would leave it when he stole, and the weak they would establish the punishment upon him, and i swear by allah, even if the daughter of Muhammad was to steal i would definitly cut her hands.
“ خُذُوا عَنِّي خُذُوا عَنِّي قَدْ جَعَلَ اللَّهُ لَهُنَّ سَبِيلاً الْبِكْرُ بِالْبِكْرِ جَلْدُ مِائَةٍ وَنَفْىُ سَنَةٍ وَالثَّيِّبُ بِالثَّيِّبِ جَلْدُ مِائَةٍ وَالرَّجْمُ ” .
Take from me, take from me, take from me, indeed allah made for them a oath a virgin with a virgin 100 whips and exile for 1 year, a married with a married 100 whips and stoning to death.
قَالَ عُمَرُ بْنُ الْخَطَّابِ وَهُوَ جَالِسٌ عَلَى مِنْبَرِ رَسُولِ اللَّهِ صلى الله عليه وسلم إِنَّ اللَّهَ قَدْ بَعَثَ مُحَمَّدًا صلى الله عليه وسلم بِالْحَقِّ وَأَنْزَلَ عَلَيْهِ الْكِتَابَ فَكَانَ مِمَّا أُنْزِلَ عَلَيْهِ آيَةُ الرَّجْمِ قَرَأْنَاهَا وَوَعَيْنَاهَا وَعَقَلْنَاهَا فَرَجَمَ رَسُولُ اللَّهِ صلى الله عليه وسلم وَرَجَمْنَا بَعْدَهُ فَأَخْشَى إِنْ طَالَ بِالنَّاسِ زَمَانٌ أَنْ يَقُولَ قَائِلٌ مَا نَجِدُ الرَّجْمَ فِي كِتَابِ اللَّهِ فَيَضِلُّوا بِتَرْكِ فَرِيضَةٍ أَنْزَلَهَا اللَّهُ وَإِنَّ الرَّجْمَ فِي كِتَابِ اللَّهِ حَقٌّ عَلَى مَنْ زَنَى إِذَا أَحْصَنَ مِنَ الرِّجَالِ وَالنِّسَاءِ إِذَا قَامَتِ الْبَيِّنَةُ أَوْ كَانَ الْحَبَلُ أَوْ الاِعْتِرَافُ .
Umar bin khattab was sitting on the mimbar of rasuallah saws: indeed Allah has sent Muhammad with the truth, he sent upon him the book And allah revealed upon him the ayah of stoning, so he read it and he learnt it and we understood it, Rasuallah SAWS did stoning and we all performed it after him. I fear that long time with the people that they will say “We did not find stoning in the book of allah, so they will be misguided because they rejected a fardth Allah revealed, indeed stoning in the book of allah is confirmed on whoever does Zina when married from a man and women, when it is proved clearly if they are pregnant or they admit it themseleves.
أَنَّهُ قَالَ أَتَى رَجُلٌ مِنَ الْمُسْلِمِينَ رَسُولَ اللَّهِ صلى الله عليه وسلم وَهُوَ فِي الْمَسْجِدِ فَنَادَاهُ فَقَالَ يَا رَسُولَ اللَّهِ إِنِّي زَنَيْتُ . فَأَعْرَضَ عَنْهُ فَتَنَحَّى تِلْقَاءَ وَجْهِهِ فَقَالَ لَهُ يَا رَسُولَ اللَّهِ إِنِّي زَنَيْتُ . فَأَعْرَضَ عَنْهُ حَتَّى ثَنَى ذَلِكَ عَلَيْهِ أَرْبَعَ مَرَّاتٍ فَلَمَّا شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ دَعَاهُ رَسُولُ اللَّهِ صلى الله عليه وسلم فَقَالَ ” أَبِكَ جُنُونٌ ” . قَالَ لاَ . قَالَ ” فَهَلْ أَحْصَنْتَ ” . قَالَ نَعَمْ . فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ” اذْهَبُوا بِهِ فَارْجُمُوهُ ” .
Indeed a man came from among the muslims to Rasuallah he was in the masjid, i called him, he said :”Ya Rasullah, i did zina. So he turned away from him, so he came round to his face and he said to him: Ya Rasuallah, I commited Zina, so he turned away from him until this repeated on him 4 times, when he testified upon himself the 4th time he called Rasuallah SAWS, so he said: “are you crazy?” he said :”No”, He Said “So are you married?” He said “Yes”, So Rasuallah SAWS Said “Go with him and stone him to death”. Ibn Shihab said “I was informed from who heard this Jabir him abdullah saying, I was amongst those who stoned him, at the time of stoning when we began hitting him with the stones he ran, so we found him and stoned him in a free place.
قَالَ جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ صلى الله عليه وسلم فَقَالَ يَا رَسُولَ اللَّهِ طَهِّرْنِي . فَقَالَ ” وَيْحَكَ ارْجِعْ فَاسْتَغْفِرِ اللَّهَ وَتُبْ إِلَيْهِ ” . قَالَ فَرَجَعَ غَيْرَ بَعِيدٍ ثُمَّ جَاءَ فَقَالَ يَا رَسُولَ اللَّهِ طَهِّرْنِي . فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ” وَيْحَكَ ارْجِعْ فَاسْتَغْفِرِ اللَّهَ وَتُبْ إِلَيْهِ ” . قَالَ فَرَجَعَ غَيْرَ بَعِيدٍ ثُمَّ جَاءَ فَقَالَ يَا رَسُولَ اللَّهِ طَهِّرْنِي . فَقَالَ النَّبِيُّ صلى الله عليه وسلم مِثْلَ ذَلِكَ حَتَّى إِذَا كَانَتِ الرَّابِعَةُ قَالَ لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم ” فِيمَ أُطَهِّرُكَ ” . فَقَالَ مِنَ الزِّنَى
Ma’iz came to Nabi SAWSand said “Ya Rasuallah Purify Me, so he said “Be aware, return and seek repentence to Allah and do tauba to him.” He Said: “So he returned not far then after and then he came and said “Ya Rasuallah Purify me” so Nabi SAWS said “ like this repeated until it happened 4 times. so he said to him (SAWS): “from what am i to purify you?” He said From Zina
أَنَّ امْرَأَةً، مِنْ جُهَيْنَةَ أَتَتْ نَبِيَّ اللَّهِ صلى الله عليه وسلم وَهِيَ حُبْلَى مِنَ الزِّنَى فَقَالَتْ يَا نَبِيَّ اللَّهِ أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَىَّ فَدَعَا نَبِيُّ اللَّهِ صلى الله عليه وسلم وَلِيَّهَا فَقَالَ ” أَحْسِنْ إِلَيْهَا فَإِذَا وَضَعَتْ فَائْتِنِي بِهَا ” . فَفَعَلَ فَأَمَرَ بِهَا نَبِيُّ اللَّهِ صلى الله عليه وسلم فَشُكَّتْ عَلَيْهَا ثِيَابُهَا ثُمَّ أَمَرَ بِهَا فَرُجِمَتْ ثُمَّ صَلَّى عَلَيْهَا
That a women fro Juhayna came to Nabi SAWS and she was pregnant from Zina. So she said “ Ya Rasuallah, The punishment is liable so activate it upon me.” So Nabi SAWS Called her Wali and he said “Be Good to her so when she gives birth bring her to me. So he did this and he ordered the punishment, so we tightened upon her her clothes, then we were ordered to stone her to death, then did salah upon her.
أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم أُتِيَ بِيَهُودِيٍّ وَيَهُودِيَّةٍ قَدْ زَنَيَا فَانْطَلَقَ رَسُولُ اللَّهِ صلى الله عليه وسلم حَتَّى جَاءَ يَهُودَ فَقَالَ ” مَا تَجِدُونَ فِي التَّوْرَاةِ عَلَى مَنْ زَنَى ” . قَالُوا نُسَوِّدُ وُجُوهَهُمَا وَنُحَمِّلُهُمَا وَنُخَالِفُ بَيْنَ وُجُوهِهِمَا وَيُطَافُ بِهِمَا . قَالَ ” فَأْتُوا بِالتَّوْرَاةِ إِنْ كُنْتُمْ صَادِقِينَ ” . فَجَاءُوا بِهَا فَقَرَءُوهَا حَتَّى إِذَا مَرُّوا بِآيَةِ الرَّجْمِ وَضَعَ الْفَتَى الَّذِي يَقْرَأُ يَدَهُ عَلَى آيَةِ الرَّجْمِ وَقَرَأَ مَا بَيْنَ يَدَيْهَا وَمَا وَرَاءَهَا فَقَالَ لَهُ عَبْدُ اللَّهِ بْنُ سَلاَمٍ وَهْوَ مَعَ رَسُولِ اللَّهِ صلى الله عليه وسلم مُرْهُ فَلْيَرْفَعْ يَدَهُ فَرَفَعَهَا فَإِذَا تَحْتَهَا آيَةُ الرَّجْمِ فَأَمَرَ بِهِمَا رَسُولُ اللَّهِ صلى الله عليه وسلم فَرُجِمَا . قَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ كُنْتُ فِيمَنْ رَجَمَهُمَا فَلَقَدْ رَأَيْتُهُ يَقِيهَا مِنَ الْحِجَارَةِ بِنَفْسِهِ .
A Jewish man and Jewish women came to me, so we went to Rasuallah SAWS until a jewish man came, so he said “What do you find in the Torah on who does Zina?” Tjeu said “ Faces will be made black, they will be made to sit on a donkey back to back and they will be made to circulate the city. So he said: “Bring me the Torah if you are truthful. so they both came with it and they read it until when the ayah of stoning came, the young man placed his hand on the ayah on stoning, so he read was was before his hand and after it, so Abdullah bin Salam said to Rasuallah “ Order him to raise his hand so h raised it and when under it was the ayah of stoning. so Rasuallah SAWS ordered for him to be stoned. Abdullahh bin umar said i was amongst were they were stoning them and i saw him trying to escape from the stones until their death.
قَالَ خَطَبَ عَلِيٌّ فَقَالَ يَا أَيُّهَا النَّاسُ أَقِيمُوا عَلَى أَرِقَّائِكُمُ الْحَدَّ مَنْ أَحْصَنَ مِنْهُمْ وَمَنْ لَمْ يُحْصِنْ فَإِنَّ أَمَةً لِرَسُولِ اللَّهِ صلى الله عليه وسلم زَنَتْ فَأَمَرَنِي أَنْ أَجْلِدَهَا فَإِذَا هِيَ حَدِيثُ عَهْدٍ بِنِفَاسٍ فَخَشِيتُ إِنْ أَنَا جَلَدْتُهَا أَنْ أَقْتُلَهَا فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ صلى الله عليه وسلم فَقَالَ “ أَحْسَنْتَ ” .
Ali was giving a speech about honouring Allah and his presence. He Said “Oh people, establish upon your slave the punishment. Whoever is married from him and whoever is not married, so indeed a slave women is for The Rasuallah who commited Zina, so he oordered me than i whip her, so when she gave birth during Nifas so i feared if i was to whip her i would kill her, so i mentioned this to Rasuallah SAWS and he said “you did good”
أَنَّ النَّبِيَّ صلى الله عليه وسلم أُتِيَ بِرَجُلٍ قَدْ شَرِبَ الْخَمْرَ فَجَلَدَهُ بِجَرِيدَتَيْنِ نَحْوَ أَرْبَعِينَ . قَالَ وَفَعَلَهُ أَبُو بَكْرٍ فَلَمَّا كَانَ عُمَرُ اسْتَشَارَ النَّاسَ فَقَالَ عَبْدُ الرَّحْمَنِ أَخَفَّ الْحُدُودِ ثَمَانِينَ . فَأَمَرَ بِهِ عُمَرُ .
Indeed Nabi SAWS bought me to a man and indeed he had drank alhocol, so he will him with 2 branches 40 times. so abu bakr also did this, so this was to indicate towards the people, so abul rahman said: “I have Decreased to 80 whips, umar did this.
أَنَّ نَبِيَّ اللَّهِ صلى الله عليه وسلم جَلَدَ فِي الْخَمْرِ بِالْجَرِيدِ وَالنِّعَالِ ثُمَّ جَلَدَ أَبُو بَكْرٍ أَرْبَعِينَ . فَلَمَّا كَانَ عُمَرُ وَدَنَا النَّاسُ مِنَ الرِّيفِ وَالْقُرَى قَالَ مَا تَرَوْنَ فِي جَلْدِ الْخَمْرِ فَقَالَ عَبْدُ الرَّحْمَنِ بْنُ عَوْفٍ أَرَى أَنْ تَجْعَلَهَا كَأَخَفِّ الْحُدُودِ . قَالَ فَجَلَدَ عُمَرُ ثَمَانِينَ .
Indeed nabi saws whipped in regards to alcohol with palm branches and shoes, then abu bakr hit 40 times, when umar and the people came close to populated areas and towns , he said “what is your opinon on the punishment about alcohol?” so abul rahman said “in my opinion it should be made the lowest form of punishment. he said “Umar hit 80 times”
“ لاَ يُجْلَدُ أَحَدٌ فَوْقَ عَشَرَةِ أَسْوَاطٍ إِلاَّ فِي حَدٍّ مِنْ حُدُودِ اللَّهِ ” .
Anyone is not allowed to hit more than 10 times except if it is from the punishment of Allah.
“ تُبَايِعُونِي عَلَى أَنْ لاَ تُشْرِكُوا بِاللَّهِ شَيْئًا وَلاَ تَزْنُوا وَلاَ تَسْرِقُوا وَلاَ تَقْتُلُوا النَّفْسَ الَّتِي حَرَّمَ اللَّهُ إِلاَّ بِالْحَقِّ فَمَنْ وَفَى مِنْكُمْ فَأَجْرُهُ عَلَى اللَّهِ وَمَنْ أَصَابَ شَيْئًا مِنْ ذَلِكَ فَعُوقِبَ بِهِ فَهُوَ كَفَّارَةٌ لَهُ وَمَنْ أَصَابَ شَيْئًا مِنْ ذَلِكَ فَسَتَرَهُ اللَّهُ عَلَيْهِ فَأَمْرُهُ إِلَى اللَّهِ إِنْ شَاءَ عَفَا عَنْهُ وَإِنْ شَاءَ عَذَّبَهُ ” .
pledge with me that upon that you do not commit shirk with Allah at all, do not commit Zina, do not steal and do not kill a soul that allah has made Haram except with the truth, whoever fulfils from you his reward lies with Allah, whoever commits any type of that he will be punished for it, it is kafarah for him. and whoever comments any one of these from that allah conceals from him, his matter is for Allah, if he wills forgiveness for him and if he will he will be punished.
