What would the appropriate instructions if area canvas identify witness with information of probative value
Advised staff that evidence of probate value must be obtained in a formal statement rather than a notebook form. There is also a need for the questionnaire to be endorsed if the statement is taken
Definition of appreciation
And appreciation is a proven method of problem-solving. The process follows a series of set steps to ensure the optimum course of action is decided upon
– and appreciation is an ongoing process which involves continually thinking through each new piece of information as it is uncovered
Obligation is imposed by 10(4) on the person providing disclosure
Provides that disclosure may be provided in whatever form, including electronically, that the person disclosing the information has it in at the time of the request, provided that this will be readily accessible to the defendant
Discuss when the OC body should strip the body of clothing or personal effects
Stripping of the body will take place immediately before the p.m. commences but must only be undertaken on the specific direction of the OC investigation, generally after a visual examination and collection of evidence from the clothed body.
Obligation when defence replaced
– Ensure replacement is provided with all material previously disclosed
– this may be achieved by obtaining in writing they have received the material from outgoing council
– or providing council with a fresh copy of material
Role of OC body during PM
Primary role of the OC body during PM is to observe, document and deal with exhibits associated with the body
Factors during an appreciation process
– Ask the question so what what does this mean in order to thoroughly examine each factor and draw logical conclusion from it
– e.g. I only have five staff, so what does that mean the answer to the question leads to logical conclusion
Upon completion of area canvas phase OC area canvas must submit a report
– Summary of all actions taken
– any significant finding highlighted
– attention drawn to any action that has been undertaken which is outside the original phase strategy
Explain what a common approach path is used for
It is an approach path for all movements into an out of the scene
– using a path which avoids any route possible taken to or from the scene by the suspect or victim
What are the specific matters regarding each exhibit must OC exhibits determine
I see exhibits will determine, plan and recall the examination and interrogation of each exhibit and establish its relevance to the investigation
The OC suspect is responsible for supervising the members of the suspect team for the purpose of
– Obtaining information about suspects and persons of interest
– thoroughly profiling and investigating all suspect and persons of interest
– seeking evidence to cover all ingredients of the offence
– providing a basis for further investigation
– mitigating and dealing with possible defences
Discuss what procedure and protective materials should be used when preparing the body for removal from the scene
– Cover hands, feet and hid with paper bags, secured with tape
– wide tape should be used, taped around the bag at a suitable anchoring point that will secure the bag to the limb
– the tape should not be so tight as to create new marks on the body and must not be applied directly to the skin
– For use of paper bags is not appropriate e.g. wet limb, then a plastic bag may be used to protect potential forensic material
– this decision should be made in consultation with the OC scene, OC investigations, crime scene coordinator
When attending it a scene where our body has been disturbed, what action should you take
Do not attempt to restore the scene to its original unchanged condition. Make inquiries to enable the original unchanged scene to be subsequently reconstructed and photographed of required
Identify
– Gather information and carrier initial scene assessment
– consider warrantless power is to deal with evidential material
– establish the crime scene itself
– consider approach path and establish a common approach path for all movement into an out of the scene, using a path which avoids any route possibly taken to or from the scene by the suspect or the victim
– consider other related crime scenes
– what is happening at the scene and who is there
– note and record observations
– establish headquarters
– provide a sitrep to comms
