A
  1. The parties are familiar with their obligations and are able to enter into an agreement with confidence
  2. There is a fair distribution of risk between the parties
  3. Quicker tendering procedures are possible, which saves time
  4. Everyone becomes accustomed to the contents of the documents, which are uniform
  5. All parties can be confident that the documents have been authorised by experts

What Amendments of Documents should not Include

A
  • Indiscriminately introduced unless absolutely necessary for the particular project, under specific instruction of the client
  • Such that unintentional legal consequences are introduced to the remainder of the agreement
  • Reproduced consistently in every tender document, regardless of whether special circumstances prevail
  • They should not be ‘embroidery’ of certain clauses which are adequately covered already
  • They should not be a simple restating of common law as this may cause confusion and alarm to tenderers
  • There should not be an introduction of clauses where the items referred to are
    measurable
