Advantages of Model Documents
A
- The parties are familiar with their obligations and are able to enter into an agreement with confidence
- There is a fair distribution of risk between the parties
- Quicker tendering procedures are possible, which saves time
- Everyone becomes accustomed to the contents of the documents, which are uniform
- All parties can be confident that the documents have been authorised by experts
- Simplified tendering process
- The documents are reliable

What Amendments of Documents should not Include
A
- Indiscriminately introduced unless absolutely necessary for the particular project, under specific instruction of the client
- Such that unintentional legal consequences are introduced to the remainder of the agreement
- Reproduced consistently in every tender document, regardless of whether special circumstances prevail
- They should not be ‘embroidery’ of certain clauses which are adequately covered already
- They should not be a simple restating of common law as this may cause confusion and alarm to tenderers
- There should not be an introduction of clauses where the items referred to are
measurable
